Reply from CIP to Issues Relevant to the Draft of Indigenous Peoples Land or Tribe Allocation Method

A public hearing was held in the office of legislator KawloIyunPacidal today (30th), stating that there are still outstanding conflicts in the Draft of Indigenous Peoples Land or Tribe Allocation Method (hereinafter referred to as Allocation Method). The Council of Indigenous Peoples (CIP) replied the questions and opinions of the hearing’s participants as following: 

 

CIP expressed that the basic law of indigenous peoples covers two types including the land of traditional areas and the reservation of indigenous people. However, there is no clear definition about the land of traditional areas in this law and other relevant laws. Moreover, various tribes might hold different concept toward it. Today the participants also presented diverse opinions for the allocation procedure and scope of traditional areas. CIP emphasized that the purpose of the Allocation Method which was amended and adopted on Jun. 24th,2015 and was set by CIP under the Article 21 of The Indigenous Peoples Basic Law is merely aiming at regulating the issues such as allocation and announcement procedure. It does not involve the change of land and natural resources rights within the range; Changes in relevant rights, according to the Article 20 of The Indigenous Peoples Basic Law, should separately set indigenous peoples land and sea law. After the land and sea law is passed, the land right of indigenous people can be protected better.

CIP stated that, since May of this year (2016), it has been conducting seminars and forums with the administrative organizations of local indigenous peoples in various places for the relevant significant laws. The number of seminars and forums has reached 32 times with about 2110 participants (as the attachment shows).Conference chairmen, leaders of various tribes or presidents of local associations are all invited. Moreover, after the forecast operation, the Allocation Method and the appointing method of legal person of public law are specially invited 8 legislators from indigenous peoples to provide opinions. Besides, CIP added 5 consulting forums for great policy for heads of the township (town, city, district) and village (neighborhood) heads according to the advice raised by the legislator Kao Chin Su Mei in the National Indigenous Peoples Sodality of Village, Town, City, and District on Oct. 6. The accuse of CIP held policy seminar without inviting local figures was not true.

 

    At last, CIP expressed that the government should confirm to people’s will and relevant policy should be in conformity with the law. The great laws and regulations of indigenous peoples established under the authority of law should also follow the original legislation spirit. The Draft of Indigenous Peoples Land or Tribe Allocation Method initially drafted by CIP strictly complies with the spirit of the Article 21 of The Indigenous Peoples Basic Law. CIP will constantly ask for opinions from various fields so as to perfect the policy.
