Transitional justice of indigenous peoples Council of indigenous peoples: can’t pass the buck

Today (26th), the Legislative Yuan of the Republic of China convenes the 1st session of the 9th appointed date, the 27th assembly of the Judiciary and Organic Laws and Statutes Committee and arranges to examine the two cases of the “Draft regulations of promoting the transitional justice to recover traditional territorial land of the indigenous peoples” and “historical justice and right recovery bill.” The chairperson, IcyangParod, of the council of indigenous peoples indicates that “The task of transitional justice has already been the priority to the government. The draft ‘promoting transitional justice regulations’ which the Legislative Yuan is now examining is only a part of the transitional justice of the whole legal project.”

 

The council of indigenous peoples emphasizes that whether analyze it via time or content, the transitional justice of the indigenous peoples should start from rebuilding the historical perspective of the indigenous peoples, territorial recovery of the issues of indigenous peoples, progressively promoting the indigenous peoples’ autonomy, reeducation of language culture, guarantee of natural resource right, righteousness of the judicial system, identity respect of the plains aborigines, and so on. On the other hand, plan the whole promoting process and more detail program to emphasize the subjectivity of indigenous peoples and the particularity to the issue of indigenous peoples’ transitional justice.

 

 

The council of indigenous peoples specifically indicates that, since 1980s, the government has already started the task of transitional justice of indigenous peoples step by step. Particularly after The Indigenous Peoples Basic Law had been drawn up, the law clearly regulates the government to ensure the basic right of the indigenous peoples and has the responsibility to recover the land rights, autonomy, education rights, culture rights, and etc. of the indigenous peoples. The transitional justice task of indigenous peoples should be practiced in the indigenous peoples’ basic law and have taken the later overall promotion of the specific regulations in The Indigenous Peoples Basic Law as the blueprint.

 


At the last, the council of indigenous peoples indicates that, with the transitional justice of indigenous peoples, it is what the folks of indigenous peoples expect that to recover and maintain the indigenous peoples’ rights and should not waste time in the endless legislation task. Besides, the President, Tsai Ting-Wen, engages in the inaugural speech promising that “My administration will work to rebuild an
indigenous historical perspective, progressively promote indigenous autonomous governance, restore indigenous languages and cultures, and improve the livelihood of indigenous communities.” At the end, the council of indigenous peoples emphasizes that what the transitional justice of indigenous peoples needs is not the legislation but immediately stepping out the brand-new step. It is believed that, under the leadership of new government, the council of indigenous peoples must take the maintaining of indigenous peoples’ rights as own responsibility, planning the most proper transitional justice program to the whole of indigenous peoples, to show the specific relationship between the indigenous peoples and the nation, and the dominant position of indigenous peoples.
